Pre-publication promotional copy with pink frontispiece cover describing endorsements from Samual Gompers, President, American Federation of Labor and Eugene V. Debs, President, American Railway Union (included). The promotional copy contains 32 full page b/w photographs (mostly by A. R. Keller) or b/w sketch drawings that would appear in the published final book. 56 pp. Text is lightly yellowed typical of the pulp paper used in the printing. Leaves are clean and unmarked. There is evidence that a page 57 may have existed, but it has been torn from this copy and is missing. (When the complete book was published, it contained 491 pp.) Inside front pastedown contains a glued down leather example of the spine for the upcoming book. In this pamphlet, Judge Leavitt states his reasons (based on historical fact and the Constitution) for his ruling that denied a writ of habeas corpus for the defendant C. L. Vallandigham; leader of the "Peace Democrats," and Supreme Commander of the "Sons of Liberty."

The accused was charged with "mischievous disloyalty" in his opinions and statements; and subsequently arrested at the orders of General Burnside. Lincoln became involved when, in May of 1863, he wrote to Stanton stating that suspension of habeas corpus, as Stanton wanted, would not be necessary in this case.

Originally born in Vienna, Kubasta trained as an architect in Prague yet barely practiced, his career interrupted by the invasion of Nazis in the Second World War. Kubašta turned his fine engineering skills towards the creation of pop-up books for children, revitalising three dimensional paper craft techniques that had drifted out of print, in part because of the bombing of the German printing presses but largely due to their expense.
