1815. ORIGINAL EARLY 19th EARLY COURT MARTIAL DOCUMENTS IN CANADA RARE

Three pages in a secretarial hand on single bifolium of foolscap paper (J Snelgrove 1814 watermarked paper) Docket title on final blank 'Private Timothy Leary 100th Regt tried at Montreal... No 4.' In red ink below: 'Laid before the P regent 28 Decm.r 1815' In pencil below: 'Disposed off'. Old folds, marginal fraying at folds, some fingermarks.

List of members of Court Martial. Leary is accused of desertion while on guard at La Prairie 'with part of his Arms and Accoutrements... and not returning till brought back by a Military Party disguised in the dress of an habitant'; pleads guilty; sentenced to death. It appears he may have been shipped to NSW aboard a ship, "Fame" in 1817 to serve a life sentence .

Signed by 'Henry : C: Darling Colonel [...] President'; and counter-signed 'Approved Gordon Drummond' with the signature of Captain George Lowndes, advocate.
