New York: James Van Norden, 1834. Hard Cover. Fair binding. Quarto. 176 pp., errata. First edition. In publishers paper backed boards with printed paper title label on the spine; untrimmed and unopened. The binding is heavily worn and soiled with only a fragment of the original label remaining; contents are foxed throughout as well as early damp-staining to the rear of the book. It remains a serviceable copy of an uncommon book. Wheaton v. Peters was the first copyright case ruled on by the Supreme Court. Of the case, Cohen writes, "Henry Wheaton, former Reporter of the Supreme Court of the United States, sues Richard Peters, current Reporter, for the copyright infringement based on Peter's inclusion in his publication, 'Condensed Reports. . . .' of decisions originally reported by Wheaton, The suit, begun in the Circuit Court of the United States for the Eastern District of Pennsylvania, sought an accounting of Peter's profits, damages therefrom, and an injunction against further sales and digesting of Wheaton's report The Circuit Court found for Peters but the Supreme Court reversed and remanded to the lower court for further findings of fact."
