Fed Civil Bullen Lil.(?) vs. Butler Tried May Thir(?) 1878. I George Marston, on oath say that I was counsel for Joseph Butler, defendant in this above case. That there was no such thing or coll__rce between the parties in the case. Their attitude in respect to the ___erce was utterly hostile. I heard the evidence hoping to see ground of defense, but the testimony of Dr. Crocker as to injuries to the ___bellant was so strong as to leave no ground on which to stand, & I was compelled, in following any judgement & my service of duty to the courts, to surrender the defense.
