There is some lighter occasional foxing throughout. There is a small piece out front the top corner of one page, not affecting the text. A tear to pages v & vi of the second book has been repaired with clear archival document tape. There are occasional marginal annotations in pencil. Good. <p>First American edition.<p>John Yate Lee's "A Treatise on the Evidence of Abstracts of Title to Real Property" precedes "George Hewit Oliphant's "The Law Concerning Horses, Racing, Wagers, and Gaming".<p>Chapter 3 of the second book (i.e. "The Law Concerning Horses, Racing, Wagers, and Gaming") includes material of veterinary interest under the heading "What Diseases orf Bad Habits Constitute Unsoundness or Vice". This chapter includes information of "Backing and Gibbing", "Blindness" (including cataracts), "Broken knees", "Capped Hocks", "Dropsy of the Heart", "Hereditary Diseases", etc. Chapter 8 outlines the law as it pertains to "Innkeepers, Farriers, Trainers and Stallion-Masters".

The pagination of the second volume is as follows: Title, [i], pages 1-506, [34] pages, and pages [1]-28. The pagination includes a separate title to the last 28 pages: "Joannis Barbeyraci Juris & Historiarum in Academia Lausannensi Professoris Ordinarii Oratio Inauguralis de Dignitate et Utilitate Juris ac Historiarum et Utriusque Disciplinae Amica Conjunctione. Quam dixit A.D.XIV, Kalend, April, MDCCXI. Editio secunda auctior & emendatior. Amstelodami: Apud Petrum de Coup, 1712." The text of this final section is in the original Latin. Barbeyrac's substantial annotations in French and Greek are printed in the margins. In addition to the engraved frontispiece, the book is enhanced by occasional decorative head and tail pieces and initials. There is some occasional soiling. There is offsetting to the title pages with early annotations regarding the dates of publication of the original edition and of this French translation penned in the margins of the title. The top front corner of the frontispiece is lightly creased. The contents are otherwise clean and the book is complete and well worth rebinding. Second edition, revised and considerably expanded. The author Samuel von Pufendorf (1632-1694) was a German jurist, political philosopher, economist and historian. He is best remembered for his commentaries and revisions of the natural law theories advanced by Thomas Hobbes and Grotius. Indeed Pufendorf had read Grotius, Descartes and Hobbes' works at the suggestion of his friend, the mathematician Erhard Weigel. A magister and subsequently a diplomat, he accompanied those who were negotiating an alliance with Denmark after King Charles X Gustav of Sweden took hostile action against the Danes. He together with others were arrested and imprisoned. He put his mind to work, during his captivity, by reflecting and meditating on what he had read of Grotius' and Hobbes' theories, building his own system of universal law on that foundation. Settling in Leiden after his release, Pufendorf published the "Elementa jurisprudentiae universalis libri duo" in 1661. His 1667 tract "On the Present State of the German Empire", though published anonymously, caused a furor for its challenge to the Holy Roman Empire, attacking the politics of the ecclesiastical princes and denouncing the faults of the House of Austria. Pufendorf's 1672 work "De jure naturae et gentium..." ["Le droit de la nature et des gens...."] drew on the theories of Grotius and Hobbes to formulate his own ideas on how to develop the laws of nations. Pufendorf took exception to Hobbes' thesis that the state of nature is one of war or conflict and instead postulated that the state of nature is one of peace. And, as this natural peace is weak and uncertain, public law recognizes the state as a moral person and that the will of the state is that of the sum of the wills of the individuals which inhabit it. The French jurist Jean Barbeyrac (1674-1744) fled to Switzerland following the Revocation of the Edict of Nantes which forced Protestants and Huguenots to flee France. He was appointed professor of history and civil law at Lausanne and eventually settled in Groningen, Germany as a professor of public law. Barbeyrac is best known for his translation of Pufendorf's "De Jure Naturae et Gentium..." with his substantial preface and marginal annotations. As with Pufendorf before him, Barbeyrac himself uses his preface to expand on John Locke and Pufendorf to work out his theory of moral obligation and distinguishing between the legal and moral qualities of action. It is not surprising that Barbeyrac also translated another of Pufendorf's treatises as well as works by Grotius and Cumberland. He authored a few of his own treatises including the "Traite du jeu" defending the morality of games of chance.

Very good. <p>Stevens sends General Horatio Wright General Bernard's anecdote [not here present] "told twelve years ago at a dinner for General Mitchell at Inverness in Scotland..."<p>Born in Barnet, Vermont, Simon Stevens [1825-1894] passed the bar in 1844. He moved to New York in 1860 and became renowned as a corporation adviser in riparian water rights. He later became president of Mexico's Tehuantepec Railroad. He was the brother of bookmen Henry and Benjamin Stevens.<p>Horatio Gouverneur Wright [1820-1899] was an engineer and general in the Union Army during the American Civil War. After the war he was involved in a number of engineering projects, including the Brooklyn Bridge and the completion of the Washington Monument.
