Were they guilty of murdering a payroll clerk . in a Braintree, MA, street? They were convicted of anarchism, not of murder, by a court and a public prejudiced by press and government agencies which fostered a red scare. Frankfurter, then a professor at Harvard Law School questioned the justice of Massachusetts. He made a survey of the case and it was published a few weeks before the death of the two defendants.
