First edition of the first American treatise on the law of evidence. At the time of writing, Zephaniah Swift (1759-1823) was one of the judges of the Supreme Court of the state of Connecticut.
FROM THE LIBRARY OF THOMAS NIXON VAN DYKE SIGNED BY HIM TWICE. Van Dyke (1803-1891) was born in Tennessee. He first practiced law in Mercer Pennsylvania before moving to Alabama in 1828. Van Dyke retuned to Tennessee in 1833 and there built his landmark home "Prospect Hill". During the Civil War both Confederate General Nathan Forrest and Union General William T. Sherman at varying times resided in Prospect Hill. A Confederate sympathizer, Van Dyke was arrested by Union soldiers in 1864 and spent the rest of the war in a prison camp.
Thomas Nixon Van Dyke has signed the book at the head of the title page and at the head of the first page of the text. There is another early signature which we have not been able to identify on the front pastedown and on the title page.
