The author contends that its identity was shaped by a prior period of prolonged popular engagement in resisting a colonial regime and goes on to show that the constitutional text can be meaningfully viewed within a specifically Indian tradition of political and intellectual history.

About the author


Sarbani Sen received her PhD at Yale Law School; she practiced law at the Calcutta High Court. She is currently a Graham Fellow at the Faculty of Law, University of Toronto and Research Associate at the Centre for Refugee Studies, York University, Toronto.
