About This Item

2008. ISBN-13: 9781584779032; ISBN-10: 1584779039. Salkowski, Carl. E.E. Whitfield, Translator and Editor. Institutes and History of Roman Private Law with Catena of Texts. London: Stevens and Hayes, 1886. xxviii, 1048 pp. Reprinted 2008 by The Lawbook Exchange, Ltd. ISBN-13: 9781584779032; ISBN-10: 1584779039. Hardcover. Slightly bumped at page edges, else very good. $150. * Reprint of the sole edition. Salkowski begins with an introduction that addresses fundamental notions of law, the history of legislation in the Roman Empire and the subsequent history of Roman law in the Eastern and Western world. The main body is divided into four sections: (I) Rights, their origin and extinction, their exercise and protection; (II) The Law of Persons (intending an exposition of the family relations); (III) The Law of Property, with subdivisions of the Law of Things, Obligations of Family Property and Inheritance; and (IV) of the Law of Procedure. "The idea of giving English students of Roman law an opportunity of becoming acquainted with the German...manuals...was well conceived, and the selection of Prof. Salkowski's work for the purpose was judicious: for it follows so far as possible the excellent plan of letting the Roman texts tell their own tale in the original, without being so long and elaborate as Puchta, Kuntze, and other writers of similar text-books. As an example of logical arrangement of topics and the matter relating to them it is almost unsurpassed.": Law Quarterly Review 2 (1886) 262.
